Assault Charges and Penalties
There are several legal categories of assault. Battery is a harmful or offensive touching of another. While judge some some discretion in sentencing, these charges and their related penalties are codified in N.C. Gen. Stat. Ann. §§ 14-32 and 14-33
Class 2 misdemeanors include assaults, batteries, and affrays. These charges result when the victim suffers minor injuries which do no require medical attention. Even if the accused has no prior conviction, the penalty could be as much as 60 days is jail and a $1,000 fine.
Class A1 misdemeanors are punishable by probation, supervised probation, or a jail sentence of one to 60 days. The judge may increase the sentence to 150 days if the defendant had prior convictions. There are several charges which are considered a Class A1 Misdemeanor. For example, when a physical altercation results in injury requiring medical attention is is consider a serious injury. It is this determination resulting in the more serious punishment. Its important to note the victim does not have to actually get medical attention. Other charges are assault with a deadly weapon, domestic violence, sexual battery, and aggravated assault.
