Once the trooper turned on his blue lights, the trooper felt that it took the defendant too long to pull over. The defendant took multiple turns before stopping in a McDonald’s parking lot. According to the trooper, this was a high crime area and he believed the defendant was going to jump and run. Once the trooper approached the vehicle, he smelled a strong odor of alcohol, noticed his eyes to be red and glassy, his speech to be slurred, the defendant admitted drinking alcohol, and the defendant questioned why the officer wanted him to do sobriety tests. Upon questioning the trooper, the trooper immediately arrested the defendant because his questions led the trooper to believe he was about to get ready to run. Mr. Marshall was able to show that the trooper had no reason to ever believe that the defendant was going to run because the defendant remained polite and compliant the entire time. Mr. Marshall was also able to show that there was no evidence of impairment that amounted to a reasonable basis for which to arrest the defendant. Mr. Marshall convinced the court that without any evidence of impairment, the trooper jumped to the conclusion that the defendant was impaired, just like the trooper wrongfully jumped to the conclusion the defendant was going to run. The court found that the defendant’s arrest was unlawful and dismissed the DWI. - [Driving Too Fast, Moving Too Slow… DWI dismissed](https://dementaskew.com/driving-too-fast-moving-too-slow-dwi-dismissed/): The defendant was stopped for travelling 94 MPH in a 65 MPH zone. Upon approach of the vehicle the Trooper claimed to have detected a strong odor of alcohol, as well as noticed slurred speech and red, glassy eyes. Due to these observations the Trooper had the defendant step out of the vehicle to perform standardized field sobriety tests. The defendant’s performance on the tests led the trooper to conclude that the defendant was impaired on alcohol and ultimately the defendant provided a breath sample that was over the 0.08 legal limit. At a hearing, Mr. Marshall was able to show that the trooper never had any legal basis to investigate DWI and should have only handed the defendant a speeding ticket. Mr. Marshall was able to show that the trooper never had an opportunity to smell the odor of alcohol, nor determine that the defendant’s eyes were red and glassy before investigating the DWI. Mr. Marshall was able to have the court rule that the trooper’s investigation of the DWI was a violation of the defendant’s fourth amendment rights, because the officer moved too slow in dealing with the speeding offense by unlawfully trying to investigate the DWI. As a result of Mr. Marshall’s work, the defendant’s breath test result was kept out of evidence and the DWI was dismissed. - [Possession with Intent to Sell or Deliver Marijuana Dismissed](https://dementaskew.com/possession-with-the-intent-to-sell-or-deliver-marijuana-dismissed/): The defendant was stopped because the tinted windows on his car were too dark. When the officer approached the vehicle, the officer was able to smell a strong odor of marijuana coming from the vehicle. Upon the search of the vehicle a bookbag was located that contained digital scales, plastic baggies, a large quantity of marijuana, and a firearm in plain view. Upon communicating with the client, Mr. Marshall learned that the bookbag was left by a passenger several moments prior to the stop. Through investigative means, Mr. Marshall was able to locate evidence which proved that the back belonged to someone other than the defendant. Mr. Marshall used this evidence to convince the Assistant District Attorney to dismiss the felony drug charge and all other related charges to the case. - [Violent Felony Dismissed](https://dementaskew.com/violent-felony-dismissed/): The defendant was employed at a fast food restaurant at which a shooting occurred. Upon review of the surveillance footage, officers were able to determine who the shooter was, and they were also able to see the defendant provide the shooter with the gun just moments before the shooting. The defendant was charged with aiding and abetting an assault with a deadly weapon with the intent to kill. Through investigation, Mr. Marshall was able to learn more about the nature of the relationship of the shooter and the alleged victim and Mr. Marshall was able to show that the defendant had a reasonable belief that the shooter was in danger before providing the firearm. Ultimately, Mr. Marshall was able to negotiate an outcome that resulted in the defendant’s charges being dropped. - [Felony Larceny Charge Dismissed](https://dementaskew.com/felony-larceny-charge-dismissed/): The defendant was an employee of a department store and was accused of stealing from the store. The store camera’s showed the defendant, who was a cashier, not ringing up several items and placing it in a customer’s basket. The defendant was approached by his store’s loss prevention personnel and provided a detailed confession. Once the police were called, the defendant was charged with felony larceny. After learning of potential witnesses, and after lengthy negotiations with the prosecutor, the felony charges were dismissed and the defendant walked away with no convictions. - [Not Guilty on Potential Aggravated Level One DWI](https://dementaskew.com/not-guilty-on-potential-aggravated-level-one-dwi/): The defendant was stopped for speeding on the interstate by North Carolina State Highway Patrol. When the troopers approached the vehicle, they immediately noted smelling a strong odor of alcohol and cigarette smoke. They also noticed that there was a child in the car. When the troopers ran the defendant’s information, they discovered that he had an alcohol restriction on his license, so they had him blow into a roadside breath test to determine if he was driving in violation of the restriction. Once they determined that he was violating the restrictions, they had him perform standardized field sobriety tests. He performed poorly on the test and was arrested for Driving While Impaired, Child Abuse, and violating his license restriction. Through a knowledge of the elements and an ability to point out what was missing from the state’s evidence, Mr. Marshall was able to have the violation of licensing restriction charge dismissed mid-trial. Through detailed cross examination questions and a knowledge of the standardized field sobriety test, Mr. Marshall was able to discredit the reliability of those test for this case and the defendant was found not guilty of Driving While Impaired and not guilty of Child Abuse. Mr. Marshall’s defense prevented the defendant of being convicted of an Aggravated Level One DWI and from facing a three year jail sentence. - [DWI Dismissed After Unlawful Search](https://dementaskew.com/dwi-dismissed-after-unlawful-search/): Officers received a call about a suspicious person. When they arrived on the scene, they found the defendant in the driver’s seat of a vehicle with his music turned up loud. They knocked several times, but the defendant did not answer the door. Officers opened the door and engaged the defendant in conversation. During the conversation the defendant admitted to consuming alcohol and admitted that he was impaired. He was given standardized field sobriety tests and officers later charged the defendant with Driving While Impaired. We were heard on a motion to suppress challenging whether the officer’s opening of the defendant’s car door amounted to an unlawful search. The case was dismissed after winning the motion to suppress due Mr. Marshall’s ability to convince the court that the officer’s search of the vehicle was unlawful. - [Not Guilty on DWI](https://dementaskew.com/not-guilty-on-dwi/): The defendant involved in a wreck on a moped. The defendant was found by emergency responders beside the moped with injuries consistent with being involved in an accident. Defendant was transported to the hospital where law enforcement responded. Upon entering the hospital room officers smelled a strong odor of alcohol and the defendant admitted to drinking prior to operating the moped. The defendant was later charged with Driving While Impaired. Due to the manner in which the blood pooled on the ground, Mr. Marshall was able to argue that the blood results obtained at the hospital were not relevant to whether the defendant was impaired at the time he operated the moped. The defendant was found not guilty of Driving While Impaired. - [Not Guilty on DWI](https://dementaskew.com/not-guilty-on-dwi-2/): Defendant was found asleep in the driver’s seat of his vehicle while his car was in the middle of the road. When he was found, his license was currently suspended for multiple prior DWI offenses. He was awakened by officers and asked to do standardized field sobriety tests. The defendant performed poorly on each of the standardized field sobriety tests. After testing, he was arrested and provided a breath sample which was over the legal limit. Through very pointed questioning of the officers and conversation with several defense witnesses, we were able to convince the court that the defendant was only a passenger who was later placed in the driver seat of the vehicle, but was too impaired to know that he had been placed there. Not Guilty on Driving While Impaired. - [No Consent, No Conviction on DWI](https://dementaskew.com/no-consent-no-conviction-on-dwi/): The defendant was involved in a single car accident in which he ran off the road and struck a tree. Officers arrived to the scene and conversed with the defendant. The defendant could not remember where he was coming from and admitted to consuming several beers before driving. After conversing with the defendant, officers’ requested a blood draw and charged him with Driving While Impaired.
