Not Guilty on DWI
Defendant was found asleep in the driver’s seat of his vehicle while his car was in the middle of the road. When he was found, his license was currently suspended for multiple prior DWI offenses. He was awakened by officers and asked to do standardized field sobriety tests. The defendant performed poorly on each of the standardized field sobriety tests. After testing, he was arrested and provided a breath sample which was over the legal limit. Through very pointed questioning of the officers and conversation with several defense witnesses, we were able to convince the court that the defendant was only a passenger who was later placed in the driver seat of the vehicle, but was too impaired to know that he had been placed there. Not Guilty on Driving While Impaired.
