The defendant was stopped because the tinted windows on his car were too dark. When the officer approached the vehicle, the officer was able to smell a strong odor of marijuana coming from the vehicle. Upon the search of the vehicle a bookbag was located that contained digital scales, plastic baggies, a large quantity of marijuana, and a firearm in plain view. Upon communicating with the client, Mr. Marshall learned that the bookbag was left by a passenger several moments prior to the stop. Through investigative means, Mr. Marshall was able to locate evidence which proved that the back belonged to someone other than the defendant. Mr. Marshall used this evidence to convince the Assistant District Attorney to dismiss the felony drug charge and all other related charges to the case.
