Drunk Driving Accident Victims: Seeking Legal Advice

Although drunk driving awareness campaigns have put the risks at the forefront of public knowledge, it is still a common problem in North Carolina and throughout the United States.  The state regularly holds campaigns and sets up checkpoints in an attempt to catch violators and discourage others.

The most recent “Booze It & Lose It” campaign ran from October 31 to November 2, 2014. Law enforcement patrolled to reduce drunk driving accidents around Halloween, which is known as one of the deadliest days of the year.According to the Associated Press, 583 people were arrested on charges of drunk driving during the campaign. An additional 16,854 people received citations for traffic or criminal offenses.

North Carolina Drunk Driving Statistics

Halloween may be the day on which most drunk driving accidents happen, but it is not the only one. The North Carolina Department of Transportation reports that there were 1124 alcohol-related crashes in 2012. This resulted in 8,486 injuries and 402 deaths. This figure represents 31 percent of all traffic-related deaths.

Although the legal definition of drunk is a blood alcohol content of .08, statistics consider all accidents in which the parties measured .01 BAC or higher.

Drunk driving is a problem across the age spectrum. The Governors’ Highway Safety Program, which creates awareness campaigns, targets men age 18 to 34. It cites research showing that this is the most prolific demographic. According to the U.S. Department of Health and Human Services, approximately 23 percent of people between age 12 and 20 have admitted to underage drinking.

Consequences of Drunk Driving

For someone convicted of a DUI or DWI, penalties can include losing a driver’s license, fines, and jail time. Repeat offenders see harsher consequences. This can be devastating to someone’s livelihood and have a lasting impact on family, friends, and career prospects.

Mothers Against Drunk Driving (MADD) is working to pass legislation that would require ignition interlocks for all offenders. Though no changes are imminent in North Carolina, 20 states have passed this requirement.

For victims, the results of an accident can be even more pronounced. Injuries commonly sustained include broken bones, head injuries, spinal cord damage, and paralysis. Health concerns can be long-lasting or permanent and often result in death.
